  • Carbon neutrality certification and consulting services
  • Carbon credit trading and purchasing
  • Corporate sustainability reporting tools
  • Other carbon management related services

We reserve the right to modify, suspend, or terminate part or all of the services at any time without prior notice.

3. Account Registration and Security

Using certain of our services may require creating an account. You agree to:

  • Provide accurate, complete, and up-to-date information.
  • Maintain the confidentiality of account information, including passwords.
  • Be responsible for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

4. User Responsibilities

When using our services, you agree not to:

  • Violate any applicable laws or regulations.
  • Infringe upon the intellectual property rights or other rights of others.
  • Post false, fraudulent, or misleading information.
  • Disseminate malware or engage in any activities that may damage our services.

The carbon emission and other data you submit should be accurate, complete, and truthful. We are not responsible for calculation or result errors caused by inaccurate data you provide. We reserve the right to verify the data you provide but have no obligation to do so.

6. Intellectual Property

DigiCarb and its licensors own all intellectual property rights related to the services, including but not limited to:

  • Trademarks, service marks, and logos.
  • Software, algorithms, and technology.
  • Website content, graphics, and designs.
  • Report templates and methodologies.

You may not copy, modify, distribute, sell, lease, or otherwise exploit our services or related content without our express written permission.

7. User Content

You retain ownership of content you submit or upload to our services. However, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and reproduce your content for the purpose of providing and improving our services.

8. Subscriptions and Payments

If you subscribe to paid services or purchase carbon credits:

  • You agree to pay all fees listed.
  • Subscriptions will automatically renew according to the selected plan unless you cancel.
  • We may change prices, but will notify you at least 30 days in advance.
  • Refunds will be processed according to our refund policy.

9. Limitation of Liability

To the maximum extent permitted by law, DigiCarb shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data loss, or business interruption. Our total liability for all damages arising from your use or inability to use our services shall not exceed the amount you have paid to us in the past 12 months or HKD 100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless DigiCarb and its directors, employees, and agents from any claims, damages, liabilities, costs, and expenses arising from your breach of these Terms, your user content, or your use of the services.

11. Third-Party Links and Services

Our services may contain links to third-party websites or services. We are not responsible for third-party content, products, or services, nor for your interactions with these third parties. Your interactions with these third parties are governed by their own terms and policies.

12. Termination

We may suspend or terminate your account or access privileges for any reason at any time without notice. You may also cease using our services at any time. Upon termination, your right to use the services will immediately cease.

13. Changes to Terms

We may modify these Terms from time to time. Modified Terms will be posted on the website and will take effect upon your next use of the services. If you continue to use our services after the changes, you accept the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to principles of conflicts of law. Any disputes arising from or related to these Terms shall be submitted to the courts of the Hong Kong Special Administrative Region having jurisdiction.
